Applicable Law
This Agreement is governed by the laws of Sweden. If you are a consumer, this does not deprive you of any protection under the mandatory laws of your country of residence, and you retain the right to bring proceedings in your local courts. Subject to that right, disputes shall be submitted to the courts of Sweden, with Attunda District Court as court of first instance for business customers or where no mandatory consumer right applies.
If you are a consumer, you may also refer a dispute to Allmänna reklamationsnämnden (ARN), Sweden's National Board for Consumer Disputes, or to the relevant alternative dispute resolution body in your own country of residence.
Right of Withdrawal (14-day cooling-off) clause
If you are a consumer within the European Union, you have the right to withdraw from your purchase within 14 days without giving any reason.
The withdrawal period expires 14 days from the day you, or a third party you designate (other than the carrier), take physical possession of the goods (or the last item, where goods are delivered separately).
To withdraw, notify us with a clear statement via email or by post to Stångjärnsgatan 2, Örebro 703 83, Sweden, before the deadline. You may use the model withdrawal form available here, but it is not required.
Effects: We will refund all payments received, including standard delivery costs, within 14 days of being notified, using the same payment method you used, unless agreed otherwise. We may withhold the refund until the goods are received back or you provide proof of return shipment, whichever is earlier. You must return the goods within 14 days of notifying us and bear the direct cost of return shipping. You are liable only for any reduction in value resulting from handling beyond what is necessary to check the goods' nature and function.
Exceptions: The right of withdrawal does not apply to sealed audio, video, or software products unsealed after delivery, goods made or personalized to your specification, and goods liable to deteriorate or expire rapidly.

Liability
To the maximum extent permitted by applicable law, Mad Mama Songs AB's liability under this Agreement, in connection with your use of the Website, or your purchase of products, is limited as set out below.
Nothing in this Agreement excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) mandatory liability under the Swedish Product Liability Act (produktansvarslagen) for defective products; or (d) any statutory consumer guarantee that cannot lawfully be excluded or limited, including under the Swedish Consumer Sales Act (konsumentköplagen).
Subject to the foregoing, and to the fullest extent permitted by law:
- We exclude all liability for indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, business, goodwill, anticipated savings, or data, whether arising in contract, tort (including negligence), or otherwise, even where we have been advised of the possibility of such damages.
- We exclude all liability arising from: (i) your inability to access or use the Website, including due to downtime, maintenance, or technical failure; (ii) delays, errors, or omissions in product descriptions, pricing, or stock availability; (iii) unauthorized access to or alteration of your data by third parties, except where caused by our failure to comply with applicable data protection law; (iv) content, products, or services of third parties linked from or sold in connection with the Website; and (v) events beyond our reasonable control.
- Our total liability for any direct loss or damage shall not exceed the total amount you paid for the product(s) giving rise to the claim.
- Any claim must be notified to us in writing within six (6) months of delivery of the relevant product, or within six (6) months of the event giving rise to the claim, except where a longer period is required by mandatory consumer protection law.
If you are a business customer, our liability for indirect or consequential loss is excluded in its entirety, and our total liability under this Agreement, whether in contract, tort, or otherwise, shall not exceed the amount you paid us in the six (6) months preceding the event giving rise to the claim. This limitation does not apply to loss or damage caused by our gross negligence or willful misconduct.
Nothing in this section affects your statutory rights as a consumer under Swedish or EU law, which take precedence over any conflicting provision in this Agreement.
